A durable power of attorney (DPOA) is a legal document prepared by an attorney and can be designated as general or specific. Naming Guardian Care Management as your agent within the durable power of attorney for healthcare permits us to make medical appointments, obtain health records, discuss care with physicians, and allows Guardian Care Management to manage healthcare overall. This involves no court action but, may only be put into place by a client who is competent and agrees to this care. You would keep the right to make decisions about your health but, the Care Manager would be able to assist with or manage your care. You are giving to your agent, or “attorney-in-fact”, control which co-exists with your own powers of decision-making. You are the principal, and the person named is your agent.
The DPOA may be very specific and state that Guardian Care Management is permitted to perform a specific service or act only when the client has temporary or permanent lack of mental capacity. It is the “durable” portion of the Power of Attorney document that permits continued decision making powers after you are no longer able to do so.
Guardian Care Management may serve as DPOA if there are no family or friends willing or able to do so and you would like to be assured your wishes are followed. An agency might be chosen if there are family members who would have difficulty following your wishes or family that may disagree. Choosing someone who is not a child, spouse, or partner removes this responsibility from someone who may be emotionally unable to fulfill the obligation. Guardian Care Management may serve as an alternate in the event your primary agent cannot serve,which is common when naming a spouse.
